CANCELLATIONS

In the unlikely event of equipment malfunction or breakdown, the Captain reserves the right to cancel the trip/reservation for safety reasons. If cancellation occurs, the client will receive a full refund.

We appreciate your understanding and cooperation in ensuring a safe and enjoyable experience for everyone!

LIABILITY WAIVER

Fishing and boating are potentially dangerous activities. Blue Barracuda Charters LLC. adheres to the highest safety and training standards, but there are inherent risks that we cannot control or eliminate. You must be aware of these risks before booking a trip with us.

THIS IS A RELEASE OF LIABILITY AND A WAIVER OF CERTAIN RIGHTS

I, the undersigned, in consideration of the services of Blue Barracuda Charters LLC., its officers, employees, contractors, agents, or representatives, hereby agree to release and hold harmless Blue Barracuda Charters LLC. on behalf of myself, my heirs, assigns, personal representatives, and estate as follows:

I understand and acknowledge that the activity I am about to voluntarily engage in as a participant carries certain known risks and unanticipated risks that could result in injury, death, illness, disease, physical or mental damage, or damage to myself, my property, or spectators or other third parties.

The following describes some, but not all, of those risks: Risks include death, drowning, bodily injury, sunburn, dehydration, insect or animal bites, wildlife encounters, and other harms during wading, boating, fishing, and related activities. I expressly agree and promise to accept and assume all responsibilities and risks of injury, death, illness, disease, or damage to myself, others, or my property arising from my participation in this activity.

By booking this charter, I acknowledge that I cannot make claims or file lawsuits against Blue Barracuda Charters LLC. or its affiliates for any injuries or damages incurred during this event.

PHYSICAL HEALTH

I, the client, have no physical restrictions that prevent my participation in any activities offered by Blue Barracuda Charters LLC., including fishing, boating, or consuming food and beverages.

I certify that I have sufficient health, accident, and liability insurance to cover any bodily injury or property damage I may incur while participating in this event, as well as any bodily injury or property damage caused to a third party as a result of my participation. If I have no insurance, I certify that I am capable of personally paying for any and all such expenses or liabilities.

Should emergency medical services become necessary for me or any minor I have authorized to participate, I agree that I will not hold Blue Barracuda Charters LLC, liable for the provision of medical and/or emergency care or the adequacy of such care. Blue Barracuda Charters LLC. reserves the right to decline service to any person it judges incapable of meeting the requirements for participation in fishing-related activities.

PERSONAL FLOATATION DEVICES/LIFE JACKETS

I acknowledge that Blue Barracuda Charters LLC. will provide life jackets for me and any minor accompanying me, and I/we are advised to wear them at all times while on the vessel, at the marina or launch area, or when otherwise instructed to do so. Failure to do so is at my/our own risk

RELEASE & ACKNOWLEDGEMENT OF RISK

I understand and acknowledge that the activity I am about to voluntarily engage in as a participant carries certain known and unanticipated risks as described in this document. I expressly agree and promise to accept and assume all responsibilities and risks while I engage in this event, and I agree that I will have no right to make claims or file a lawsuit against Blue Barracuda Charters LLC, or its officers, contractors, agents, or employees.

By booking this charter, I, as parent or guardian of any accompanying minor, unconditionally release and hold harmless Blue Barracuda Charters LLC. and/or their representatives from all liability, costs, expenses, claims, and damages for which the charter might otherwise become liable due to any accident, illness, injuries, or death of any persons, or damage to property, arising from or related to participation in any activity or service offered by Blue Barracuda Charters LLC., regardless of how, where, or when such injury, illness, death, or damage occurs, even if caused by the negligence of the charter, its agents, contractors, or employees, or due to conditions or defects in the vessel, equipment, or activities.

By booking this charter, I acknowledge that I have read and understood this document, its impact on my legal rights, and agree to its terms. I, the client, understand all its terms and that it shall be effective and binding upon myself, my heirs, successors, and assigns. I execute it voluntarily with full knowledge of its significance.
